Abstract:
The work analyzes the definition of Functional Homicide, highlighting the qualification of
crime against authorities, spouse, partner or blood relatives up to the third degree. It
explores the possibility of the qualifier being applied when the adopted child is the
taxable person. Compares the legal treatment of biological and adopted children in
different areas of law, discussing the protection of family members of public servants.
Examines the nature of functional homicide, legal interpretations and the extent of
protection to adopted children, using doctrines and jurisprudence. It also analyzes the
concept of "family" in the criminal environment.

O trabalho analisa a definição de Homicídio Funcional, destacando a qualificadora do
crime contra autoridades, cônjuge, companheiro ou parentes consanguíneos até o
terceiro grau. Explora a possibilidade da qualificadora ser aplicada quando o filho
adotivo é o sujeito passivo. Compara o tratamento jurídico do filho biológico e adotivo
em diversas esferas do Direito, discutindo a proteção aos familiares de servidores
públicos. Examina a natureza do homicídio funcional, interpretações jurídicas e a
extensão da proteção aos filhos adotivos, utilizando doutrinas e
jurisprudências. Analisa também o conceito de "família" no meio penal.
