ALIMENTOS GRAVÍDICOS E A POSSIBILIDADE DE INDENIZAÇÃO POR DANOS MORAIS E MATERIAS AO SUPOSTO PAI

Abstract

The present essay is based on the Brazilian Law 11.804/08, that refers to child support before birth, analyzing innovations brought by this law, as well the concept of pre birth child support, unborn child rights explaining the three visions about the beginning of legal personality of unborn, and the possibility of reparation damages to the alleged father in case of paternity exams that denies the paternity. Analyzing this law, is perceived that the same exist to guarantee the rights of the pregnant to receive child support needed from the alleged father to handle expanses from the pregnancy and beyond, even the pregnant just showing indications of paternity, because the child support for a unborn child is linked to a the right to life, dignity of the unborn child and a healthy and safe pregnancy. Yet, there are some points that need in depth study so that the alleged father don't suffer financial losses.
