A EFICÁCIA DAS MEDIDAS PROTETIVAS DA LEI MARIA DA PENHA NO COMBATE À VIOLÊNCIA CONTRA A MULHER

Abstract

This research will analyze the phenomenon of domestic and family violence in the light of the Maria da Penha Law, focusing on the application of urgent protective measures provided for in Law 11.340/2006. When thinking about the theme of the proposed work, the author came up against the following issue: are the protective measures addressed by the Maria da Penha Law effective in ensuring that being women do not suffer further attempts on their lives, given the possible recurrence of aggressions suffered by women? To achieve the research result, the data collection technique adopted was guided by the literature review, in order to be able to explain the subject more clearly to the reader. Thus, this legal essay aims to highlight the Maria da Penha law and domestic violence, highlighting any protective measures that guarantee the safety of women and pointing out whether there is any type of offense for possible non-compliance with the protective measure. It took centuries of struggle against machismo so that violence against women was, in fact, understood as a offense and, especially in Brazil, it took years of struggle and suffering so that, finally, a law to protect women came into force in the parents. With the research, it was noticed, therefore, that the Maria da Penha Law still does not provide full confidence to victims of domestic violence whom this legal diploma really aims to protect.
