ESTÁGIO DE CONVIVÊNCIA E A DEVOLUÇÃO IMOTIVADA DE CRIANÇAS E ADOLESCENTES EM PROCESSO DE ADOÇÃO

Abstract

The present paper aims to answer the following question: does the cohabitation stage constitute a right established in favor of the adopters, in such a way as to legitimize "unjustified dismissals of adoptees"? Addressing doctrinal and jurisprudential concepts to equate the problem presented in the attempt to create a solution to the conflict. In addition, data from the Social Service of the 1st Childhood and Youth Court of Vitória were used in order to demonstrate the current situation of the duration of the cohabitation stage. In addition to addressing the possibility of compensation to the child and the adolescent if they are to be returned during the stage of coexistence.
