A CONDENAÇÃO COM BASE NA PALAVRA DA VÍTIMA EM CRIMES SEXUAIS E O PROCESSO PENAL

Abstract

The present paper aims to answer the following question: To base a criminal conviction on sexual crimes only on the victim's word. Analyze and question current jurisprudence, which gives the word of the victim greater probative value, especially in sexual crimes, especially since, as a rule, these crimes are practiced sneaky. To answer the research, it is questioned: Is it worthy for the individual as a human person, to be condemned having only the victim's word, and the criminal procedure disposes of all the evidence necessary for the conviction? To do so, we will analyze criminological doctrines, scientific articles and legislation.
