| Resumo: | The purpose of this article is to answer the following question: Are the fundamental rights of children involved in international adoption guaranteed during the process, in particular the right to education and the right to nationality? Therefore, as a solution to the problem, this article seeks to demonstrate the lack of legal obligations exposed to the State to guarantee through its institutions the guarantee of the fundamental rights of the children involved in international adoption and the actions that it must take. Based on bibliographic research and jurisprudence, the article assesses, through the inductive method, the institute of international adoption, and how Brazilian law and the State guarantee that these minors can have their fundamental rights guaranteed, regardless of whether they become citizens of other countries. |
