PRODUTOS COM NANOTECNOLOGIA E A DEFESA DO CONSUMIDOR: A FALTA DE REGULAMENTAÇÃO NO ORDENAMENTO JURÍDICO BRASILEIRO EM FACE DO CÓDIGO DE DEFESA DO CONSUMIDOR

Abstract

This research aims to answer the following question: How to guarantee safety and information on the consumption of nanotechnology products and products that use nanotechnology? The article will analyze the "Consumer Protection Code", mainly regarding the principles of consumer vulnerability, state intervention, "good objective faith" and education and information, to explore how to ensure safety and information on consumption of nanotechnology products and products that use nanotechnology. Using legislation and bibliographies about the subject, it is found that the deficiency in the Brazilian legal system in the regulation of the use of the new technology, against to the scientific omission as to the toxicity of the products, damages the right of the consumer to have proper and clear information about the different products and services, with correct specification of quantity, technical features, composition, quality and price, as well as the risks presented. 1
