| Resumo: | The present article aims to analyze the observance of the constitutional principles of the adversary and the ample defense in the police investigation. This study aimed to define the legal nature of the investigation, certifying that it is the same administrative, the police investigation is not a mandatory part for the filing of a criminal action, but only informative; However, its main function is the investigation of the existence of a crime and its authorship, it can be verified the need to make truly the defense of the investigated in the course of the police investigation, the constitutional principles of the contradictory and ample defense legitimized by the Art. 5, subsection LV of the Federal Constitution of 1988, appears to be an extremely relevant tool that can and should be explored in order to ensure that the fundamental right of individuals is not harmed at the stage of criminal investigation. |
| Descrição: | O presente artigo possui escopo de analisar a observância dos princípios constitucionais do contraditório e da ampla defesa no inquérito policial. Este estudo buscou-se definir a natureza jurídica do inquérito, certificando ser a mesma administrativa, o inquérito policial não é peça obrigatória para a propositura de ação penal, mas apenas informativa; no entanto, sua função principal é a apuração da existência de um delito e sua autoria, pode-se constatar a necessidade de se fazer verdadeiramente ampla a defesa do investigado no curso do inquérito policial, os princípios constitucionais do contraditório e da ampla defesa legitimados pelo art. 5°, inciso LV da Constituição Federal de 1988, afiguram-se como uma ferramenta extremamente relevante, que pode e deve ser explorada a fim de garantir que o direito fundamental dos indivíduos não seja lesado na fase da investigaçãocriminal |
