SÍNDROME DA MULHER DE POTIFAR: ANÁLISE JURÍDICA DOS IMPACTOS CAUSADOS PELA DENUNCIAÇÃO CALUNIOSA DE ESTUPRO, PERPETRADA POR MULHERES, CONTRA SEUS (EX) COMPANHEIROS COMO FORMA DE VINGANÇA PESSOAL

Abstract

This article aims to work the new understandings, about the articles foreseen in the Penal Code and Penal Procedure that deal with crimes against sexual dignity. Highlighting its applicability and the jurisprudence understandings for the case that will be discussed. Initially, we will work on the concept of the Potiphar Woman Syndrome, developed by criminology, where a woman who, after being rejected by a “slave”, with her wounded ego, plans her revenge, regardless of the fate that the man would have accused, the falsely attempting to take advantage of it, that is, committing criminal conduct. We will try to answer the problem that arises with this theme, not talking about its emergence and application in the Brazilian penal system, but rather on the probative value of the victim's word, by itself, it is already enough to convict a person. After that, we will bring a bibliographic review of authors who dedicated themselves to the debate and writing on this topic, bringing their understandings and conclusions in an objective and schematic way.
