PARENTALIDADE SOCIOAFETIVA: A POSSIBILIDADE DA DUPLA PATERNIDADE E SEUS EFEITOS JURÍDICOS

Abstract

This article has the following research problem: What are the effects of double parenting in the legal world? It is a bibliographical research based on the selection of articles and books with themes pertinent to the topic, as well as legal documents and jurisprudence on the subject analyzed. It was concludedthat the effects of dual paternity in the legal world, based on the Extraordinary Resources and General Repercussion recognized by the Supreme Court, focus above all on the importance of preserving the dignity of the human person and the right to seek happiness irrespective of the attempts of the State to frame its family reality in models pre-conceived by the law, as it is quoted in the STF's judgment of August 24, 2017 on sociativity. Thus, social paternity, whether or not declared publicly, does not prevent the recognition of the affiliation in a concomitant way on the basis of biological origin, having legal effects of its own.
