| Resumo: | The objective of this work was succinctly presented the institute of multiparenting, its emergence based on affective family constitutions, the informative guiding principles that enabled its recognition as well as the effects of this recognition for succession purposes and how the applicability of the rules in cases of recognition of inheritance rights to multiparental ascendants. It is also intended to demonstrate that despite being a great advance for Family Law and a social achievement, the heritage issue arising from the recognition of multiparenthood, that is, the constitutional right to training, is still a complex issue, the target of major debates and studies in the legal field, especially regarding the division of assets regarding the ascending heirs. We use bibliographic and jurisprudential research as the main method. |
| Descrição: | O objetivo do presente trabalho foi apresentar de forma sucinta o instituto da multiparentalidade, o seu surgimento baseado nas constituições familiares afetivas, os princípios norteadores informativos que possibilitaram seu reconhecimento assim como os efeitos deste reconhecimento para fins sucessórios e como se daria a aplicabilidade das regras em casos de reconhecimento de direitos sucessórios aos ascendentes multiparentais. Pretende-se, ainda, demonstrar que apesar de ser um grande avanço para o Direito de Família e uma conquista social, a questão patrimonial decorrente do reconhecimento da multiparentalidade, qual seja, o direito constitucional à herança, ainda é um tema complexo, alvo de grandes debates e estudos em âmbito jurídico, principalmente com relação à divisão de bens quanto aos herdeiros ascendentes. Utilizamos como principal método pesquisa bibliográfica e jurisprudencial. |
