A ARGUMENTAÇÃO COMO PRINCIPAL FATOR DE INFLUÊNCIA NO RESULTADO DO TRIBUNAL DO JÚRI

Abstract

The present work is a research that will have as its main objective to address the influence that the communicator has within a legal process, from the context of the Jury court. The Jury Court does not only concern legal practitioners, but also the active participation of society. Thus, we will serve as the Jury Court to provide considerations on what a Prosecutor, a Defense Lawyer and society can, through argument, define whether or not to convict a defendant. To this end, we will explain the concepts of Rhetoric, Oratory and Dialectic, as well as analyze the applicability of these capabilities as influencing factors in the results of the Jury Court. From an analysis of legal arguments, we will follow a path through the works of Aristotle, Marco Túlio Cícero, Chain Perelman and Olivier Reboul, to provide an understanding of the place that Communication occupies as the main factor of influence in the Jury Court.
