| Resumo: | This article aims to analyze the legal criteria regarding matrimonial impediments in Brazil, addressing the changes in the Civil Codes of 1916 and 2002, as well as Decree Law No. 3,200/41. The perspective addressed is that of avuncular marriage, which involves third-degree collateral relatives (uncles and nephews), and its implications in light of the Brazilian legal system. Through qualitative, bibliographical and documentary research, this study addresses the evolution of the legal recognition of same-sex unions by the STF, with a main focus on the impact of constitutional principles such as equality, non-discrimination and human dignity. Another point also addressed is the problematization of same-sex relationships between close relatives, analyzing the criteria of the health of the offspring and criteria of morality, with the intention of identifying gaps in the legislation. |
| Descrição: | O presente artigo busca analisar os critérios legais em relação aos impedimentos matrimoniais no Brasil, tratando das mudanças dos Códigos Civis de 1916 e 2002 , bem como do Decreto Lei n° 3.200/41. A perspectiva abordada é a do casamento avuncular, na qual envolve parentes colaterais de terceiro grau (tios e sobrinhos), e suas implicações à luz do ordenamento jurídico brasileiro. Por intermédio de pesquisa qualitativa, bibliográfica e documental, este estudo aborda a evolução do reconhecimento jurídico das uniões homoafetivas pelo STF, com foco principal para o impacto de princípios constitucionais como a igualdade, a não discriminação e ainda a dignidade da pessoa humana. Outro ponto também abordado é a problematização do relacionamento homoafetivo entre parentes próximos, analisando os critérios da saúde da prole e critérios de moralidade, com a intenção de identificar lacunas na legislação. |
