REFLEXÕES SOBRE A PALAVRA DA VÍTIMA NOS CRIMES CONTRA A DIGNIDADE SEXUAL

Abstract

The article studies the victim's speech in cases of sexual assault, elucidating the importance of speech as a source of evidence within Brazilian justice. The analysis aims to discuss the psychological and also legal consequences of oral evidence, with an emphasis on procedural guarantees, taking as an example hearing, hearings shown orally, full protection, competing procedures, logically within a fair trial in which the parties are respected also. The methodology of analyzing academic articles was used, relevant publications that focus on the analysis of the victim's words, causes and effects that bring back the trauma of sexual violence added to the rights that the defendant has, brought in quantitative form, example of the NVivo software. The objective of this analysis is also to explore principles such as self-responsibility included in both parts of the process, the granting and provision of evidence always in the light of the transparency of the process, with the main path being to promote treatment that is equal, both of the victims and the accused, honoring the constitutional rights of those involved. And in the end, the investigation proposes a debate on the principles involved in this legal balance between the person accused and the victim, always involving transparency and impartiality.
