A CONSTUTUCIONALIDADE DO REGIME DISCIPLINAR DIFERENCIADO: ANÁLISE CRÍTICA E JURISPRUDENCIAL

Abstract

This article examines the constitutionality of the Differentiated Disciplinary Regime (DDR) with in the context of the Brazilian penitentiary system, conducting a critical analysis of relevant legislation, jurisprudence from higher courts, and the controversies surrounding its application. The DDR, instituted to discipline and control the conduct of prisoners deemed highly dangerous, imposes severe restrictions on in mates interactions and activities. The research addresses the constitutional principles that guarantee human rights and the dignity of the human person, questioning whether the DDR, in its current form, respects these precepts. Through the analysis of significant judicial decisions and existing literature, the study seeks to understand the tensions between public safety and fundamental rights, culminating in reflections on the need for reforms in the Brazilian penal system.
