dc.descriptionO presente artigo científico tem como objetivo abordar o instituto da judicialização da saúde que é utilizado como maneira de alcançar a efetividade do direito a saúde, protegido pela Constituição Federal de 1988, que enfatiza que trata-se de um direito fundamental concernente a todos os cidadãos, pertencendo ao Estado a incumbência de garanti-lo. Todavia é constatado o crescimento de forma significativa do número de demandas judiciais que compelem a Administração Pública a arcar com tratamentos, medicamentos, insumos, dentre outros serviços que não são oferecidos pelo Sistema Único de Saúde, o que ocasiona uma considerável oneração no orçamento dos cofres públicos. À vista disso, é propicio a implantação de um mecanismo que auxilie na solução das demandas da saúde e que atenue a procura do Poder Judiciário neste âmbito. Isto posto, objetiva-se aludir sobre o instituto da mediação como método consensual de resolução de conflito, que pode ser executada pelas Câmaras Privadas de Conciliação e Mediação.pt_BR
dc.description.abstractThis scientific article aims to address the institute of judicialization of health that is used as a way to achieve effectiveness of the right to health, secured by the Federal Constitution of 1988, which emphasizes that it’s about a fundamental right that concerns all citizens, with the State in charge of guaranteeing it. However, there is a significant growth in the number of lawsuits that compel the Public Administration to pay for treatments, medicines, supplies, among other services that are not offered by the Unified Health System, which causes a considerable burden on the budget of public resources. In this case, the implementation of a mechanism that helps in the solution of health demands and that mitigates the demand of the Judiciary in this area is favorable. That said, the objective is to allude to the institute of mediation as a consensual method of conflict resolution, which can be carried out by the Private Chambers of Conciliation and Mediation.pt_BR
